How Bonds Work in Georgia

When a person is arrested for a crime, they are assigned a court date, and a judge sets a bail amount required for their release until the hearing. Once bail is set, the defendant has three options: pay the full amount in cash, remain in jail until the court date, or hire a bail bond agency to post bail on their behalf.

Paying bail can place a significant financial burden on the defendant or their family. However, staying in jail until trial can negatively impact the defendant’s case and employment. For many, hiring a bail bond agency is the most practical and appealing option.

Bail bond agencies in Georgia operate similarly to those in other states, following general regulations that set a cap on the fees they can charge. In Georgia, agencies typically charge a non-refundable fee ranging from 12% to 15% of the total bail amount. This fee covers the service provided by the agency and cannot be returned.

What You Need To Know

A bail bond is a portion of the total bail amount and allows a defendant to be released from jail under specific conditions. These conditions are outlined in a contract between the bail bondsman and the person(s) paying the bond, known as the indemnitor. This contract is then submitted to the court. One key condition is that the indemnitor accepts full responsibility for ensuring the defendant appears in court as required.

Once the defendant meets all obligations outlined in the contract, the bail bond is considered complete, and the agreement is terminated. However, if the defendant fails to appear in court, the bail is forfeited, and the indemnitor becomes financially liable for any costs involved in locating and returning the defendant to custody.

“I've used other bondsman in the past and Savannah Bail Bonding was the best experience I’ve had! They were extremely helpful and fast! They felt more like family then a bondsman company. The turn around on my money was super quick and easy. I hope I don’t have to use a bondsman company again but if I do I wouldn’t go to anyone else!!!”
